JUSTICE DENIED - Radio Log (CAD) - Trying to obtain exculpatory evidence since 2004. Judge ruled in case 2018-00018104-CU-WM-CTL the County of San Diego had to release the evidence. They have never released the CAD which would show the conversation of the officer, which in turn would prove that he provided false testimony under oath. The refusal to provide the exculpatory evidence in this case sent him to prison for 25 yrs. to life - He had never been to prison before. Antwoine sued again to have them release the true GPS. They filed a lawsuit under the Res Judicata doctrine. The case is on appeal to require them to turn that information over.

The location of the officer between the time the officer was dispatched, and Mr. Bealer was picked up and taken to station is all missing. JUSTICE DENIED - Trying to obtain video of officer attacking Mr. Bealer since October 2009. Mr. Bealer was attacked by two officers at Corcoran State Prison. He tried continuously to obtain the video. Mr. Bealer stated the officers attacked him unprovoked. The officers stated Mr. Bealer attacked them. Someone is not being truthful. The video will show the truth. Mr. Bealer has gone through all protocols to obtain this information. They will not release it. They sued Mr. Bealer and gave him an additional 25 years. The two officers also personally sued him, and one officer was rewarded $5000 and the other $2500. If the video supports Mr. Bealer's side of the story this means the state knew the officers were being untruthful and they callously permitted Mr. Bealer to be prosecuted and sent through all this anguish. This also means two officers benefited off this lie. The officer awarded the $5000 was awarded $5000 for suing another inmate. Release the video.

He tried continuously to obtain the video. He stated the officers attacked him unprovoked. Mr. Bealer sued the officer however without the video to show what exactly happened the officer was acquitted. The video will show the truth. Mr. Bealer has gone through all protocols to obtain this information. They will not release it. CDCR moved Mr. Bealer two weeks before his trial. They gave him only limited access to his legal documents preventing him from preparing for his trial. If this video had been released of the officer attacking him, his chances of winning this case would have increased.
JUSTICE DENIED - When Antwoine entered the prison system for the first time in his life he was given the wrong placement score. Which affected his programming. CDCR labeled him as a gang member. The probation reports states "The defendant is not in Cal-Gangs" . This move increased his placement score. CDCR has refused to correct this mistake. He has filed numerous 602's and tried every avenue he can to correct it. Title 15 Section 3378.2 details the validation process for identifying and documenting STG (Security Threat Group) members. There are processes CDCR must follow to validate your as STG member. They have followed none of these processes for Antwoine. "Initial Validation of an offender as a member requires at least three (3) independent source criteria items with a combined value of 10 points or greater coupled with information/behavior indicative of a member." Imagine being mislabeled as a STG and having to constantly deal with that deadly mistake.
